The council has a total of 75 seats, of which 63 are elected and 12 are nominated. The elected members are elected by indirect elections, with each district electing one member. The nominated members are appointed by the governor of Bihar.

The term of office of the members of the council is six years. The council is presided over by the chairman, who is elected by the members of the council. The current chairman of the council is Avdesh Narayan Singh.

The functions of the council are to:

• Discuss and approve the budget of the state government.
• Pass laws on matters that are not specifically assigned to the lower house, the Bihar Legislative Assembly.
• Investigate matters of public importance.
• Control the expenditure of the state government.

The council has the power to delay the passage of bills passed by the assembly, but it cannot veto them. The council can also initiate legislation, but its bills must be passed by the assembly before they can become law.

The council has played an important role in the development of Bihar. It has helped to ensure that the interests of all sections of society are represented in the state legislature.
